Duty of judiciary as constitution's guardian is unparalleled: Justice Borhanuddin

DHAKA, Feb 27, 2024 (BSS) - Justice Borhanuddin of the Appellate Division today said the duty of the judiciary as the guardian of the constitution is unparalleled.
 
"Constitution is the supreme law of the country. Executive, parliament and judiciary complement each other. In spite of this, duty of the judiciary as the guardian of the constitution is unparalleled as it has the right to check whether any law passed by the parliament is inconsistent with the constitution, or not. The judiciary even has the power to check whether any activity of the executive wing is contrary to the fundamental rights," he added.
 
The senior apex court judge said these while addressing his farewell reception accorded by Attorney General's office and Supreme Court Bar Council.
 
Earlier Justice Borhanuddin took part in the trial proceedings for the very last day with Chief Justice Obaidul Hassan and his four other colleague judges, Justice M Enayetur Rahim, Justice Md Ashfaqul Islam, Justice Md Abu Zafor Siddique and Justice Jahangir Hossain, at the apex court.
 
Born on February 28, 1957, Justice Borhanuddin obtained his LLB degree from the University of Chittagong.
 
He was enrolled as an advocate of the District Court on March 3, 1985. Justice Borhanuddin was enrolled as the advocate at the High Court Division on June 16, 1988, and at the Appellate Division on November 27, 2002.
 
Justice Borhanuddin was elevated as Additional Judge of the High Court Division on November 16, 2008, and was appointed Judge of the High Court Division on November 11, 2010.
 
He was elevated to the Appellate Division of the Supreme Court on January 9, 2022.
