DHAKA, July 14, 2024 (BSS) - The Appellate Division of the Supreme Court has scrapped the leave to appeal brought against a High Court judgment, upholding the admission cancellation of 169 students of Viqarunnisa Noon School and College (VNSC) of the capital.

A three-judge Appellate Division Bench led by Chief Justice Obaidul Hasan gave this order today.

Mohammad Rafiul Islam, lawyer of the principal of VNSC told the newsmen that, "As a result, there is no legal obstacle for the school authorities to admit students from the waiting list in the 169 vacant seats."

A 29-page verdict of a High Court Division Bench comprising Justice JBM Hasan and Justice Razik-Al-Jalil was published on the Supreme Court website on June 27.

The verdict stated that the admission of 169 class one students of the school was conducted by avoiding the age norms set by the government.

The education ministry ordered probing the entire admission process and recommended introducing a better admission process and finding out the culprits, the verdict said. Also, action will be taken against identified criminals as per law, it stated.

For this, the Secretary of the Secondary and Higher Education Ministry was asked to form an inquiry committee of 3 members.

On January 14, the guardians of two students seeking admission in class one filed a writ alleging that age norms were not being followed.

The school authorities canceled the admission of 169 students and on March 6, and the High Court directed them to take admission in vacant seats within a week from the waiting list.

The parents of the students, whose admission were canceled appealed to the Appellate Division against that order.

Separate writ was filed for 120 students whose admissions were canceled.

The High Court announced the verdict on May 21 after a joint hearing on the rules.

A leave to appeal was filed after the publication of the copy of this judgment. The Supreme Court dismissed the hearing scrapping the appeal today.
